    Bihar government decides to recommend CBI probe in Sushant Singh Rajput death case

    The Bihar government has decided to recommend a CBI probe in film actor Sushant Singh Rajput’s death case , Chief Minister Nitish Kumar said Tuesday, even as a debate raged on whether it has the jurisdiction to do so.

    "The Bihar DGP had a talk with the late actor's father KK Singh today. DGP has informed me that the father has asked for a CBI probe into the case, Kumar told the media.

    Bihar DGP Gupteshwar Pandey told ET the recommendation letter would be sent by the state government later in the day.

    “We will send our proposal to the Home department for a CBI probe into the case. Home department will send it to the chief minister. I expect the formalities for the recommendation of the CBI probe to be completed within two hours,” Pandey said.

    Bollywood actor Rajput was found dead at his apartment in suburban Bandra in Mumbai on June 14, and since then Mumbai Police has been probing the case.

    The case turned into a political tussle with ruling parties in Bihar - where assembly elections are being held later this year - alleging the probe was not being conducted fairly.

    Rajput’s father lodged an FIR with Rajeev Nagar police station of Patna on July 25 under various sections of the Indian Penal Code, naming actor Rhea Chakaraborty and her family members.

    Subsequently, a four-member team of Bihar police reached Mumbai to investigate the case which is at present being probed by the Maharashtra police, but the government there placed the team leader under quarantine.

    Meanwhile, the lawyer for Rhea Chakraborty has been quoted by PTI as saying the Bihar government's decision to recommend CBI inquiry has "no legal sanctity" as it has "no jurisdiction" over the matter.

    "The petition filed by Rhea Chakraborty in SC that Bihar Police had no jurisdiction to Investigate the case will continue... There cannot be a transfer of a case which had no legal basis for Bihar to get involved," lawyer Satish Maneshinde said in a statement.

    At the most it would be a "Zero FIR" and transferable to Mumbai Police, he claimed, adding that the method adopted by the Bihar govt was "illegal".

Patna Superintendent of Police Vinay Tiwary arrived in Mumbai on August 02. Bihar Police team is investigating the case in city after actor’s father filed FIR against Rhea Chakraborty.
