Extremely negative judgement. Instead helping tax authorities to book such fraudsters irrespective of the time period court is directly justifying such deeds under the garb of retrospective clause. Very unfortunate indeed. Centre should bring in amendment to give retrospective effect to the new law.

The judicial system can punish innocent people and protect the criminals. Forget Benami Amendment Act, No law can be effective retrospectively. Otherwise we will have chaos in the country. We have to find another way of nailing these cheats.
Maybe, but why forget the entire amendment? It is needed at least on a go forward basis...

Offence is an offence. Why should not the law be effective for older offences?
One more fact is that Income Tax people are also giving color of benami property to old cases so that they may get promotion.....When property has been earned by someone using unfair/illegitimate means, the case of corruption is applicable. But just to please the government that so many Benami cases have been found, income tax people are falsely converting straight forward cases into Benami cases.

Such Orders are to protect the corrupts and looters of nation''s wealth. Government needs to make such orders ineffective. Judiciary needs to be told not to create road-block to fight against corruptions.

You cannot become brainless in application of laws. If tomorrow, a stup!d govt brings law that non-veg eating is crime and police and govt forces start applying it from 1980, how would that be. Have common sense too. Justice should be done and seen too.
Well said, Govt alone cannot be held responsible to stop corruption, Judiciary has to play its role and deliver the order keeping in mind the larger picture of corruption rather than interpretation of provisions
