Chief Justice of India Ranjan Gogoi has recommended the name of the next senior most judge in the Supreme Court pecking order, Justice Sharad Arvind Bobde, as his successor as per convention, and a letter to this effect has been sent to the law ministry, official sources confirmed.

CJI is required to formally send in a request to this effect at least a month in advance before demitting office. The formal appointment comes through after the law ministry sends it to the home ministry. In turn, it is sent to the President’s office which issues a formal warrant of appointment.

Any such appointment to the top court is made by the President under his hand and seal. Justice Gogoi demits office on November 17, this year.

According to convention, the CJI recommends the second senior most judge in the court hierarchy as the next CJI. The convention is iron-clad.

A break from this tradition had taken place only once during Emergency when former PM Indira Gandhi superseded several judges, including the legendary Justice HR Khanna, to bring in Justice AN Ray as the CJI.

Justice Bobde takes over from CJI Gogoi as the 47th CJI, and will be sworn in at the Rashtrapati Bhavan. Justice Bobde will hold the office till April 21, 2021.

Official sources said that the law ministry will process his papers soon. Born in Nagpur, Justice Bobde has been part of several key judgements delivered recently such the right to privacy and Aadhar judgements.

Known to be polite and soft-spoken, Justice Bobde belongs to a family of lawyers.
