Supreme Court dismisses all Ayodhya review petitions

Five review pleas filed were filed against the apex court's November 9 judgement. One petition was filed by the Muslims parties and one by a group of intellectuals. The Nirmohi Akhara, which was ousted as the sebait, or a caretaker, and instead given a single-member representation in any trust or body which would be set up to build a Ram temple at the site, had also filed a review of the ruling.

  • Among the reviews listed for Thursday are five review pleas filed by the Muslims parties and one by a group of intellectuals. The Nirmohi Akhara, which was ousted as the sebait, or a caretaker, and instead given a single-member representation in any trust or body which would be set up to build a Ram temple at the site, has also sought a review of the ruling.

In the backdrop of gunning down of the four accused by Telangana police in an encounter, Chief Justice of India S A Bobde said that the recent events in the country have shaken the firm position of justice system as justice must never ever take the form of revenge and justice loses its character if it becomes revenge.

"I believe the institution (judiciary) must correct itself and indeed it did during the time when the much-criticised press conference was held. It was nothing more than a self-corrective measure and I do not wish to justify it," Justice Bobde said during the inauguration of a new building of the Rajsthan High Court.

Settling the fractious issue that goes back more than a century, the Supreme Court on November 9 backed the construction of a Ram temple by a government trust at the disputed site in Ayodhya and ruled that an alternative five-acre plot must be found for a mosque in the Hindu holy town.

The minister's statement came after Congress leader in Lok Sabha Adhir Ranjan Chowdhury asked the government when political leaders, including sitting member and former chief minister Farooq Abdullah, would be released.

The Supreme Court had taken into account that three judicial officers of the eight recommended by the Bombay High Court had crossed the prescribed age limit. However, the SC found Debadwar, Tavade and Kulkarni fit for elevation, keeping in view their excellent service records and the need for more judges, given the increasing pendency of cases.

The minister said there are 704 fast-track courts for heinous offences and others and the government is in the process of setting up 1,123 dedicated courts for POCSO and rape offences. "In the law relating to women violence, we have already laid down capital punishment and other severe punishment including completion of trial in two months time," he added.

The onus will be on Speaker Om Birla to ensure smooth functioning of the House, especially on a day when Union home minister Amit Shah is slated to introduce the contentious Citizenship (Amendment) Bill, 2019, the Congress party believes.

Apart from Chowdhury, leader of opposition in Rajya Sabha Ghulam Nabi Azad, chief whip in Lok Sabha Kodikunnil Suresh and whip Gaurav Gogoi, among others, attended the meeting.

Justice Gogoi's tenure as judge and as CJI was marked by some controversies and personal allegations but that never came in his way of his judicial work that was reflected in the last few days when benches headed by him delivered some path-breaking judgements.

The new roster is slightly different from the last time when the outgoing CJI Ranjan Gogoi had kept PIL matters for top five judges of the apex court, including the CJI. Besides PIL matters, CJI Bobde has kept with him matters of contempt, election, habeas corpus, social justice, direct and indirect tax cases, among others.
