  • CJI SA Bobde suggested that there ought to be some norms or guidelines restricting information seekers of all kinds. Those seeking information must have some locus, he said. He seemed to suggest that some people had made a profession out of the RTI by seeking information for vested interests and were using it to blackmail others.

    The ruling came on an application filed by banks, which said such information cannot be shared without first giving them an opportunity to oppose it. The top court had mandated the RBI in 2015 to release such information to RTI applicants or risk contempt of court.

    Hearing a case filed by whistleblower bureaucrat Sanjiv Chaturvedi, the transparency watchdog said the central public information officer (CPIO) has "grossly erred" in invoking the veil of section 24 of the RTI Act mechanically without assessing the nature of information sought and the same is viewed adversely by the commission.

    The main task of the CDS will be to ensure jointmanship among the three services which will include powers to work on setting up of few theatre commands as well as to allocate military assets among the services to synergise their operations. At present, the three services coordinate their work under the framework of the Integrated Defence Staff (IDS).

    Reading out the judgement, Justice Sanjiv Khanna said the independence and accountability go hand in hand and that independence of the judiciary can't be ensured only by denying information.

    A five-judge constitution bench headed by CJI Ranjan Gogoi will pronounce the judgement at 2 pm. Other members of the bench are Justices N V Ramana, D Y Chandrachud, Deepak Gupta and Sanjiv Khanna.

    In the show-cause notice, Chandra directed the CPIO why penal action under Section 20(1) of the RTI Act should not be initiated against him. This is not the first time that the RBI had to face the ire of CIC as former Information Commissioner Sridhar Acharyulu had summoned then RBI Governor Urjit Patel for not following Supreme Court orders on RTI implementation.

    Rs 31.86 crore were received in 2017-18 and Rs 227.94 crore in 2018-19 as penalties, the CPCB had said in a response to the query made under the Right to Information (RTI) Act. Rs 122.27 crore have been received in compensation in 2019-20 till October 31, the CPCB stated in response to the query made by Noida-based RTI activist Ranjan Tomar.

    "We have opposed these amendments in Parliament and will continue to oppose them in practice. We condemn this piecemeal destruction of our democratic institutions and will continue to fight the Modi government in these self-serving actions which are the very opposite of national interest," she said.

    It is proposed to appoint the CIC in to succeed the incumbent on completion of the tenure likely on January 11, 2020, it said. Sudhir Bhargava is the Chief Information Commissioner. Besides the top post in the CIC, the government has also decided to fill the four vacant posts of Information Commissioners.

    The Union has directed its departments to allow government-certified training institutes to condust transparency audits in order to facilitate proactive disclosure of information to the public which is mandated by the Right to Information (RTI) Act, 2005, so that people have to use the transparency law less to get information.

    As Jammu and Kashmir Reorganisation Act became operational on October 31, the central RTI Act became applicable in J&K and Ladakh. However, there is no clarity on how 364 cases filed under the state’s law would be handled. Like RTI cases in all union territories, Central Information Commission (CIC) would hear cases from J&K and Ladakh.
